Welcome to Ryder Wear by Sound Off Live, a brand operated by Sound Off Live, LLC (“Sound Off Live,” “Ryder Wear by Sound Off Live,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of our websites, online store, products, content, social-media-related content, and services.

By visiting our website, purchasing a product, submitting content, or otherwise using our services, you agree to these Terms. If you don't agree with them, please don't use the site or purchase our products.

Pretty straightforward. The lawyers would probably use more words. We're going to use plenty already.

1. Who We Are

Ryder Wear by Sound Off Live is an apparel and lifestyle brand operated by Sound Off Live, LLC.

Our products and content reflect our brand's personality, including Texas and Southern culture, faith, family, country, sports, hunting, country life, humor, opinion, satire, and occasionally saying out loud what everybody else was apparently just thinking quietly.

Some content may be humorous, sarcastic, satirical, irreverent, or opinionated. That's intentional.

Being offended by a joke does not necessarily mean that a legal right has been violated. At the same time, legitimate legal, privacy, intellectual-property, or name/image/likeness concerns will be taken seriously as described below.

2. Online Store Terms

You must be legally capable of entering into a binding agreement to purchase products through our store.

You may not use our website, products, designs, photographs, trademarks, graphics, or services for an unlawful or unauthorized purpose.

We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including suspected fraud, payment problems, inventory errors, pricing errors, abuse of our policies, or unlawful activity.

3. Products and Product Information

We make reasonable efforts to accurately represent our products, including their colors, graphics, materials, dimensions, and appearance.

However, actual colors and appearance can vary because of monitor settings, garment manufacturers, printing processes, fabric, lighting, photography, and ordinary production variations.

Many Ryder Wear by Sound Off Live products may be printed or fulfilled after an order is placed. Minor variations in graphic placement, dimensions, texture, or color are normal and do not necessarily constitute a defect.

Product descriptions, prices, designs, and availability may change without notice.

4. Sizing and Fit

Customers are responsible for reviewing available sizing information before purchasing.

Fit varies among garment manufacturers, cuts, fabrics, and styles. Words such as “fitted,” “relaxed,” “oversized,” “crop,” and “unisex” are general descriptions and cannot guarantee how a garment will fit every individual person.

Please consult the applicable size chart before ordering.

We make shirts. Unfortunately, we have not yet figured out how to make everyone's body obey the same size chart.

5. Orders and Payments

Submitting an order does not guarantee acceptance.

We may cancel an order for legitimate business reasons, including inventory shortages, suspected fraud, payment issues, incorrect pricing, technical errors, or fulfillment problems.

If we cancel an order after collecting payment, the appropriate amount will be refunded through the applicable payment method, subject to ordinary payment-processing procedures.

Customers agree to provide accurate billing, shipping, contact, and payment information and represent that they are authorized to use the payment method submitted.

6. Shipping and Fulfillment

Some products may be produced, printed, packaged, or shipped by third-party fulfillment providers.

Processing and delivery dates are estimates unless expressly guaranteed.

Sound Off Live, LLC is not responsible for delays outside its reasonable control, including carrier delays, severe weather, natural disasters, labor interruptions, transportation disruptions, incorrect customer-provided addresses, or similar circumstances, except to the extent otherwise required by law.

Our posted Shipping Policy is incorporated into these Terms.

7. Returns, Exchanges and Refunds

Returns, exchanges, cancellations, and refunds are governed by our posted Return and Refund Policy, which is incorporated into these Terms.

Customers should review that policy before completing a purchase.

Nothing in these Terms eliminates any consumer right or remedy that cannot lawfully be waived.

8. Name, Image and Likeness

Sound Off Live and Ryder Wear by Sound Off Live may feature photographs, videos, testimonials, social-media content, promotional material, event photographs, models, customers, contributors, or other individuals in connection with our brands.

Where authorization is legally required, we intend to obtain appropriate permission for commercial use.

If you believe that your name, photograph, image, likeness, video, voice, or other personally identifiable content is being used by Sound Off Live or Ryder Wear by Sound Off Live against your wishes, we want to know.

Send a written removal request or cease-and-desist notice to:

Please identify yourself, the material involved, where it appears, and enough information for us to reasonably verify the request.

We will promptly review legitimate and reasonably verifiable requests and, when appropriate, remove or discontinue the disputed use.

And yes, we get it. Sometimes people are babies and think way too highly of themselves. Shame on us for looking at you and thinking, “You know what? That person would make a great model.”

That's on us.

Just send the email. You don't need to hire a marching band, contact six cousins, or announce that your legal team is “exploring all available options.” Tell us what you want removed, give us enough information to find it, and we'll address it promptly.

Removal of disputed material does not constitute an admission by Sound Off Live, LLC that the original use was unauthorized, unlawful, infringing, or otherwise improper, nor does voluntary removal constitute an admission of liability.

9. Intellectual Property

Unless otherwise stated, original Sound Off Live and Ryder Wear by Sound Off Live logos, graphics, apparel designs, photographs, written material, branding, and other original content are owned by or licensed to Sound Off Live, LLC and are protected to the extent afforded by applicable law.

Purchasing one of our products does not transfer ownership of the underlying artwork, branding, designs, or other intellectual property.

You may not reproduce, manufacture, commercially distribute, sell, license, or exploit our protected material without appropriate authorization.

Third-party trademarks and intellectual property remain the property of their respective owners.

10. Important Ryderwear.com Non-Affiliation Notice

Ryder Wear by Sound Off Live is a brand operated by Sound Off Live, LLC.

Sound Off Live, LLC and Ryder Wear by Sound Off Live are NOT Ryderwear.com.

Sound Off Live, LLC and Ryder Wear by Sound Off Live are not affiliated with, sponsored by, endorsed by, partnered with, authorized by, associated with, operated by, or under common ownership with Ryderwear.com, Ryderwear (Aust) Pty Ltd, or its affiliated companies or brands.

References on our website to “Ryder Wear” are intended as references to Ryder Wear by Sound Off Live, our brand, unless expressly stated otherwise.

We do not represent that our products originate from Ryderwear.com or any other unrelated company using RYDERWEAR or a similar name.

Any trademarks, trade names, logos, or other intellectual property belonging to Ryderwear.com, Ryderwear (Aust) Pty Ltd, or another third party remain the property of their respective owners. Sound Off Live, LLC does not claim ownership of another party's registered trademarks.

Customers should understand that purchasing from Ryder Wear by Sound Off Live means purchasing from the Sound Off Live brand and not from Ryderwear.com.

Same neighborhood of words. Different house. We don't have their keys, they don't have ours, and nobody is sharing a Netflix password.

For the avoidance of doubt, nothing on this website should be interpreted as representing or implying an affiliation, sponsorship, endorsement, partnership, licensing relationship, or common ownership between these separate businesses.

11. User-Submitted Content

If you voluntarily provide us with a review, photograph, video, testimonial, comment, or other material, you represent that you have the legal right to provide it.

Where you expressly authorize us to use submitted material for promotional purposes, you grant Sound Off Live, LLC a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, and use that material in connection with Sound Off Live and Ryder Wear by Sound Off Live marketing, subject to applicable law.

Submission of material alone does not automatically transfer ownership of your underlying intellectual property to us.

12. Opinions, Humor and Satire

Sound Off Live is, unsurprisingly, a platform where people sound off.

Our website, products, podcasts, social-media accounts, advertising, and related content may contain opinions, jokes, commentary, parody, satire, sarcasm, cultural observations, sports commentary, and other expressive material.

Opinions expressed by hosts, contributors, guests, models, customers, or other individuals do not necessarily represent the opinions of every person associated with Sound Off Live, LLC.

Humorous, satirical, or opinion-based content should be understood in its context and is not intended to communicate false statements of fact about another person or business.

We reserve the right to have a personality. Apparently websites are still allowed to have those.

13. Third-Party Services

Our website and store may rely on third parties for ecommerce hosting, payment processing, manufacturing, printing, fulfillment, shipping, analytics, and communications.

Those third parties may maintain their own terms and privacy policies.

Use of a third-party provider does not necessarily mean that provider sponsors or endorses Sound Off Live or Ryder Wear by Sound Off Live.

14. Prohibited Uses

You may not use our website to commit fraud, violate applicable law, introduce malicious software, interfere with website security, unlawfully collect information, impersonate another person, infringe intellectual-property rights, or attempt unauthorized access to our systems.

You also may not reproduce our original merchandise designs for commercial resale simply because you successfully right-clicked the picture.

Technology has come a long way. Copyright law noticed.

15. Errors and Inaccuracies

Our website may occasionally contain typographical mistakes, incorrect prices, inaccurate descriptions, inventory errors, or other errors.

We reserve the right, to the extent permitted by law, to correct errors and update information.

If an error materially affects an order already placed, we will take reasonable steps to provide an appropriate resolution.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE, CONTENT, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT GUARANTEE THAT OUR WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM TECHNICAL PROBLEMS.

NOTHING IN THESE TERMS DISCLAIMS A WARRANTY OR CONSUMER RIGHT THAT CANNOT LEGALLY BE DISCLAIMED.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOUND OFF LIVE, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF OUR WEBSITE OR SERVICES.

WHERE LIABILITY CANNOT LAWFULLY BE EXCLUDED, LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Nothing in these Terms limits liability where limitation or exclusion is prohibited by law.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Sound Off Live, LLC and its owners, officers, employees, agents, and contractors from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of our services, material violation of these Terms, or infringement of another person's rights.

19. Privacy

Our collection, use, and handling of personal information is governed by our posted Privacy Policy.

Third-party payment processors, ecommerce providers, fulfillment providers, analytics services, and other providers may process information necessary to provide their respective services.

20. Governing Law

These Terms and transactions with Sound Off Live, LLC are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in these Terms deprives a consumer of protections that cannot lawfully be waived.

21. Severability

If any portion of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed as appropriate.

The remaining provisions will continue in effect.

In other words, if one paragraph gets kicked out of the bar, everybody else doesn't have to go home.

22. No Waiver

Our decision not to enforce a provision of these Terms on one occasion does not waive our right to enforce it later.

23. Changes to These Terms

We may revise these Terms periodically to reflect changes in our business, services, website, or applicable requirements.

Revised Terms become effective when posted unless applicable law requires otherwise.

Continued use of our website following an update constitutes acceptance of the revised Terms to the extent permitted by law.

24. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies expressly incorporated by reference, constitute the agreement governing use of our online store and related services.
